What kind of crisis is Sudan experiencing in the Middle East?

On September 13th, local time, the UN Security Council held an open meeting on the situation in Sudan. In his briefing to the Security Council, the UN Secretary-General’s Special Representative for Sudan, Volcker perthes, said, "The armed conflict in Sudan shows no signs of abating, and neither side can win a decisive military victory. Since the outbreak of the conflict, at least 5,000 people have been killed and more than 12,000 injured. This is only a conservative estimate, and the actual number of casualties may be higher … … Sudan faces the risk of division. The conflict that began between the two armed forces is likely to escalate into a full-scale civil war in Sudan. "

The conflict in Sudan continues to be deadlocked.

Many forces are involved in the war.

From April 15th this year, two factions of Sudan’s former military camp — — The exchange of fire between the Sudanese Armed Forces and the Rapid Support Forces in the capital circle, Darfur, Kordofan and other places has continued to this day. On September 15th, the conflict in Sudan has entered its sixth month. The two sides of the conflict still show no signs of stopping fighting, and conflicts in many places continue to be deadlocked. Under the cloud of war, the situation in Sudan is "out of control".

If you want to ask where the conflict situation attracts the most attention, it is Khartoum State in the capital circle. For more than five months, the two sides of the conflict have launched an attack on important military facilities, bridge crossings and supply routes. The rapid support force is highly mobile, and gradually goes deep into the community to fight street battles. At present, it has occupied the vast majority of sites in Khartoum. The Sudanese armed forces used the advantages of heavy weapons and air strikes to fight back.

How to fight hand to hand? For example, since the beginning of August, the Sudanese Armed Forces and the Rapid Support Force have been fighting fiercely around the armored headquarters base in the southwest of Khartoum. The base has a large number of tanks, ammunition and military vehicles, but the area is actually small, only 1.57 square kilometers. Today, the two sides still control the east and west sides respectively, and it is difficult to capture them all.

△ The battle for the armored headquarters base in the southwest of Khartoum continues.

Throughout Sudan, the Sudanese armed forces still firmly control the northern and eastern regions. In Darfur, the rapid support force formed an alliance with the local Arab tribal militia and controlled most of the area. Around the capital cities of Kordofan, siege and counterattack are also staged alternately.

There are far more than the above two camps involved in armed conflicts, and violent conflicts among four tribes in Darfur are also expanding. According to the statistics of local medical institutions, at least 260 people have been killed and more than 540 injured in the conflict between Bani Halba and Salamat in Southern Darfur. In the conflict zone, people’s communities were burned, livestock were killed and vehicles were destroyed. The reasons for the outbreak are not only the mutual robbery between tribes due to economic factors, but also the support of different tribes for two opposing armies, which deepened the contradictions between them. In addition, many local forces in Sudan are also divided into groups, either eyeing "neutral" observation or directly joining the battle.

An important change affecting the war situation in Sudan occurred on August 24. On the same day, Borhan, Commander-in-Chief of the Sudanese Armed Forces, successfully withdrew from the headquarters of the Sudanese Armed Forces in Khartoum, which was besieged by the other side, and then arrived in Port Sudan, the "administrative capital" on the Red Sea by helicopter. On this day, it was also the first time that Borhan appeared in public since the conflict broke out.

△ On September 13th, local time, Borhan, commander-in-chief of Sudanese Armed Forces, held talks with Turkish President Erdogan.

Since then, Borhan has made intensive overseas visits from Port Sudan to Egypt, South Sudan, Qatar, Eritrea, Turkey and Uganda, actively seeking extensive support from neighboring countries. It is reported that seeking weapons and financial assistance from these "friendly countries" is of vital importance to the Sudanese armed forces. At present, most of the industrial and military facilities in Khartoum have been destroyed, and it may be a long process for the armed forces to reproduce weapons and ammunition.

The two sides of the conflict are sharply opposed.

The dawn of peace has not yet dawned

There is also a recent trend worthy of attention. The Sudanese armed forces have suddenly stepped up their air strikes and extended their strike network to areas outside the capital circle. Statistics show that in the past two weeks, there have been at least 150 deaths caused by air strikes. For example, on September 10th, the Sudanese Armed Forces attacked a free market in the south of Khartoum, causing at least 40 deaths and more than 60 injuries. The tragic degree made doctors in local hospitals call it "horror and shock".

This is the largest number of civilian deaths in a single attack since the outbreak of armed conflict in Sudan. The area attacked by air is controlled by the rapid support force and heavily manned. A person familiar with the matter pointed out that the target of the air strikes by the Sudanese Armed Forces is likely to be the market for goods trading by the Rapid Support Force, which is also one of the main economic sources of the Force.

△ After the air raid on a market in Khartoum, the wounded were treated in a nearby hospital.

In the face of the protracted armed conflict in Sudan, although both sides of the conflict kept making promises verbally and were open to ceasefire and peace talks, they did not forget to shout at each other frequently. The Sudanese Armed Forces regarded each other as "rioters" and "traitors", while the Rapid Support Force attacked each other as "remnants of the former dynasty" and "old forces" representing the military government. After international mediation, the two sides reached a ceasefire agreement in Saudi Arabia several times, but the agreement has never been effectively implemented.

On the current situation in Sudan, Borhan once said, "Now is not the time for negotiation. We must invest all our strength to destroy the rebels in the battle. " D ‘Gallo, the leader of the Rapid Support Force, even threatened that "if we want, we can come to Sudan today". The analysis believes that since Sudanese President Bashir was dismissed in 2019, and then the civilian transitional government was overthrown in 2021, the two sides have always been in step. It was not until the military government came to power, involving real power distribution, military merger and economic benefit sharing, that it finally came to nothing. The contradiction between the two armed camps is irreconcilable for a long time, and the dawn of peace in Sudan is still far away.

Desperate people’s livelihood under the bonfire

Half of Sudan’s population is in dire need of humanitarian assistance.

International human rights organizations say that Sudan is no longer walking on the edge of atrocities, but has "fallen into the abyss".

The bullet left a mark, and the armed conflict triggered a severe humanitarian crisis, which has been strongly concerned by the international community. According to the UN report, there are currently more than 24.7 million people in Sudan who are in urgent need of humanitarian assistance, which is about half of Sudan’s total population. The Sudanese people are experiencing an unimaginable disaster where the war is burning.

Five months after the conflict broke out, the key war zones between the two sides have been hit hard. It is difficult to find an inch of intact land in the streets of Khartoum, the capital, and the whole city is devastated. The infrastructure in a large number of residential areas is damaged, and power, water and poor communication often occur, and banks and gas stations also stop serving.

Due to blocked traffic lines and poor logistics, there is a shortage of food in residents’ homes. According to United Nations data, the armed conflict in Sudan triggered a sharp rise in food prices. At present, about 20.3 million people in Sudan are facing food insecurity, and at least 700,000 children are severely malnourished and face the risk of death. The persistent conflict also endangers the planting and production of crops this year, which will further aggravate the food crisis in Sudan.

△ Within one day, a bullet landed at the door of a resident in Omdurman.

The normal life of many Sudanese has come to a standstill. Whether it is a government agency or a private enterprise, employees are experiencing "salary cut" for several months, which adds to people’s economic burden.

Sudan’s domestic medical system has also been hit hard. At the worst, 80% of hospitals in the country can’t operate normally. The hospitals in Khartoum, the capital, and the central and western regions of Darfur are the first to bear the brunt. The shortage of drugs and medical devices has become a universal problem in China, and the dialysis patients who need to go to the hospital every week are particularly worried. For safety reasons, some doctors even turned their home into a clinic. On social networks in Sudan, people exchange ideas and discuss how to give birth to pregnant women at home.

September is supposed to be the start of school in Sudan, but it is difficult for Sudanese students to return to school in conflict-affected areas. According to the statistics of UNICEF, about 19 million school-age children in Sudan are facing the problem of no schooling. The Sudanese education department has stated that the start of school depends on when the conflict ends.

  △ Sudanese children under conflict

An economic crisis may have arrived. Since September, the exchange rate of Sudan’s national currency, the Sudanese pound, has depreciated sharply against the US dollar, and the domestic inflationary pressure has risen sharply. The war caused Sudan’s largest refinery to be forced to shut down and the fuel supply chain was seriously damaged. Some mineral resources companies in the Sultanate also said that the conflict has caused the gold production to drop to 2 tons this year, while the total output will reach 18 tons in 2022. Sudan was once the second largest gold exporter in Africa. In July this year, Sudanese economists generally predicted that the economic losses caused by the armed conflict in Sudan had reached 9 billion dollars, equivalent to 100 million dollars a day.

On September 13th, the latest report released by the International Organization for Migration showed that up to now, the armed conflict in Sudan has caused more than 5.25 million people to be displaced. Among them, more than 4.11 million people from 820,000 families fled in Sudan, most of them fled from Khartoum State, where the fighting was the fiercest, and more than 1.13 million Sudanese refugees fled to Chad, Egypt and South Sudan. It is worth noting that Sudan has been one of the largest refugee receiving countries in Africa before the outbreak of this conflict. When the war broke out, these refugees had to embark on a tortuous and arduous migration road again.

△ The conflict in Sudan has displaced more than 5.25 million people, and a large number of refugees have taken refuge in refugee camps in neighboring countries.

At present, there are various predictions about the situation in Sudan, one of which is that if the armed conflict in Sudan continues to escalate, it will not be ruled out that there will be "two governments" in the east and the west at the same time. In the 67 years since Sudan’s independence, it has experienced three civil wars, which lasted for more than 40 years. This time, people can’t help but ask, if a full-scale civil war breaks out again, how long will it last, what will be the impact, and how long will the suffering of the Sudanese people last?

A violet in a hot house! The anniversary of the death of Chuanyin elders was held in Lushan Mountain, Jiangxi Province.

Magnolia in early spring exudes a rich fragrance, and Lushan Mountain, which has been raining for several days, suddenly turns warm and sunny. Many senior monks and great masters gathered at the foot of Lushan Mountain to cherish the memory of well-known religious patriots, outstanding Buddhist leaders in China, respected contemporary famous senior monks, the former honorary president of the Chinese Buddhist Association, honorary dean of the China Buddhist College, retired Torinji of Lushan Mountain, and the elder Yuan Chuanyin, the seat of Beijing Fayuan Temple.

At 14: 00 p.m. on March 26th, 2024, the anniversary of the death of the Chuanyin elder was held in Taibai Hall, the third floor of Yilu Pavilion, Tang Taizong Hotel, Lushan Mountain, Jiangxi Province.

Master Ming Hai, resident vice president of Chinese Buddhist Association and executive vice president of China Buddhist College, Lin Jianwei, second-class inspector of Jiangxi Provincial Bureau of Ethnic and Religious Affairs, Master Chun Yi, vice president of Chinese Buddhist Association and honorary president of Jiangxi Buddhist Association, deputy secretary general of Chinese Buddhist Association, legislator Yang, deputy secretary general of Jiangxi Buddhist Association, Master Chun Wen, vice president of Jiangxi Buddhist Association, Master Tong Neng, Vice President of Jiangxi Buddhist Association and President of Xinyu Buddhist Association, Yu Zhi, Third-level Investigator of United Front Work Department of Jiujiang Municipal Committee, Zhou Jie, Standing Committee Member of Lushan Municipal Committee and Minister of United Front Work Department, Mei Chongjun, Secretary General of Jiangxi Buddhist Association, Master Xing Miao, President of Dalian Buddhist Association in Liaoning Province, Master Xuan Yi, President of Lvliang Buddhist Association in Shanxi Province, Honorary President of Jiangxi Buddhist Association and Master Da ‘an, Abbot of Lushan Torinji, and other leaders and guests attended the commemorative meeting. Also attending the commemorative meeting were Torinji Zuting and Pure Land Garden, as well as masters, methods, precepts and students from all over the country, and nearly 1,000 people, such as Master Zhushande and dharma-protecting lay people, who had deep ties with the tradition. The commemorative meeting was presided over by Master De Shou of Lushan Torinji Prison.

At the first item of the anniversary meeting, everyone stood up and sang the national anthem.

Master Ming Hai, Vice President of Chinese Buddhist Association and Executive Vice President of China Buddhist College, delivered a speech. He said that the elder Chuanyin is a shining example of Buddhism’s patriotism and love of religion, and he adheres to the family’s faith and ethics and the fine tradition of Buddhism. He has experienced loneliness and prosperity, suffering and glory, and he has never changed his true colors, and he has never forgotten his ambition of altruism. When the lead is washed away, he will return to the original, and the last one will predict the time and live freely. It is a model of noble monks and great virtues, which deserves our experience and study. He returned to the pure land and advocated Buddhism, but he also traveled to the sea of mind and law, extensively studied various schools, and was not confined to the portal. He avoided fame and fortune, but was loyal to the leader, Monk Lun. He was deeply divorced from life and death, and was deeply worried about the teaching of Buddhism. He treated people like a spring breeze, cordial and frank. In today’s comprehensive and strict management of religion, his pure monk style is beneficial to him and deserves our admiration and study. The virtue of the elder Chuanyin is not only the precious spiritual wealth of the four disciples of Buddhism, but also the moral resources shared by the whole society. He is the epitome and representative of countless eminent monks and great virtues who have created excellent Chinese traditional culture in the history of China Buddhism for more than 2,000 years. It is hoped that with the support of the Party and the government at all levels and under the leadership of Master Da ‘an, the Jingzong Zuting, which promoted the revival before its death, will prosper and make new and greater contributions to the construction of a strong country and national rejuvenation.

Lin Jianwei, the second inspector of Jiangxi Provincial Bureau of Ethnic and Religious Affairs, said in his speech that the elder Chuanyin has always loved his country and religion all his life, worked with the party and the government with one heart and one mind, practiced the concept of human Buddhism, and devoted his life to the healthy inheritance of Buddhism in China and made important contributions. The best memory is to let the good words and deeds of the elders of Chuanyin inspire their successors in the Buddhist cause, and become a positive driving force for the healthy and orderly development of fine traditions in the Buddhist circles of Jiangxi and even the whole country. I hope that the vast number of Buddhists in the province will inherit the will of the elders, learn from their excellent qualities of patriotism, diligence and altruism, continue to carry forward the fine traditions of Buddhism, adhere to comprehensive and strict teaching, and further promote the Buddhist China in China. Unswervingly follow the road of adapting to the socialist society, lead the vast number of Buddhist believers to work with the people of the whole province to make new and greater contributions to writing a Chinese-style modern Jiangxi chapter.

Master Chun Yi, vice president of the Chinese Buddhist Association and honorary president of the Jiangxi Buddhist Association, said that the elder Chuanyin is the leader of Buddhism in China, and he is an ordinary person who has made extraordinary achievements, and his vivid image will live in our hearts forever. The elder is also a respected teacher, who speaks silently, teaches by example, and reveals his compassion and wisdom everywhere, so that we can learn the wisdom and dew of Buddhism from him. The elder is also a bodhisattva who has changed the world. He does not seek happiness for himself, but hopes that all beings will get rid of suffering. The elder is also a scholar, whose works are equal and diligent, leaving us with many magic weapons of writing, which we can study all our lives. The elder is a Buddhist leader. As the president, he led the Buddhist circles in China, displayed the ideas of China Buddhism on the world Buddhist stage, and established a good image of China Buddhism. He is also committed to the cause of peace and human progress, and is our forever respected mentor. We should cherish our good marriage with the elders in this life.

Yang, deputy secretary-general of the Chinese Buddhist Association and president of the Jiangxi Buddhist Association, said that Shui Yue had no trouble to prove it, and he was born in a dream. We are here to commemorate the life of the elder’s lotus, to remember the elder’s deep prestige and virtue, and to wish you all the best. Pilu is a sea, but the teacher holds the lamp. The spirit of the elders, only the bodhisattva is willing to do it; The belief of the elders, only the pure land is willing to do it; The mind of the elders, but I don’t want to do it; The spirit of the elders is fearless and willing to do it. The stone spring will ring, and the sea will be endless; Outside the porch, the spring branches are flourishing. I hope we can put our hearts into it, practice our actions, encourage others, and be deeply impressed.

Yu Zhi, a third-level researcher of the United Front Work Department of Jiujiang Municipal Committee, said in his speech that the elders of Chuanyin have lofty moral character and spiritual demeanor, and have a deep relationship with Jiujiang. The elders attach great importance to the cultivation and growth of monks, carry forward Torinji’s thousand-year-old family style of observing precepts and chanting Buddha, and promote the revival of the lotus ancestral hall. Today, with the continuous efforts of the three generations of abbots of Guoyi, Chuanyin and Master Da’ an, Torinji in Lushan has established a unique pure land Sect culture as its core characteristic. The best memorial to the elders of Chuanyin is to learn, inherit and carry forward their political consciousness of loving the party, patriotism and socialism, their enduring pure faith, their selfless and altruistic bodhisattva’s willingness to do things, their self-discipline spirit of adhering to the precepts and chanting Buddha’s words, their self-discipline spirit of setting an example, their true nature of not wanting to be satisfied, and their fearless spirit of breaking evil and showing righteousness.

Master Xing Miao, the representative of the elder disciples and the president of Dalian Buddhist Association in Liaoning Province, said that the world is a law of karma and also a law of birth and death. We have to face the fact that the elder has left us for a whole year. Seeing the earth-shaking changes of the ancestral home, seeing the giant Buddha from scratch, every building embodies the painstaking efforts of the mentor and Master Da ‘an everywhere. It is the elders who have made the Zuting, the Giant Buddha and the Da ‘an monk. This is the teacher’s silent entrustment and order to his disciples, so that these disciples, methods, students and monks who are distributed all over the country should support the Zuting and admire the Giant Buddha. Only in this way can we live up to the teacher’s high hopes and make the Zuting’s practice great.

Finally, Master Da ‘an, honorary president of Jiangxi Buddhist Association and abbot of Lushan Torinji, delivered a speech on behalf of Torinji. First of all, Master Da ‘an thanked all the elders from various mountains and Master Dade for coming to attend the memorial meeting of the death anniversary of the elders who passed away. Everyone could come, which also shows that there is a deep legal relationship with the elders. The Master put forward the idea and proposal of setting up a research society for the elders of Chuanyin, based on the suggestions of the senior brothers of Chuanlao Sect. Master Da ‘an said that the hardships experienced by the elder Chuanyin in his life are just like the spirit of Mencius that "Heaven will descend to Sri Lanka, and he must first suffer from his mind". Chuanyin is a violet flower that grows out of suffering. His experiences and qualities are worth studying and learning. I hope more people who have a relationship with Chuanyin will participate. Handing down the old is not only Torinji’s, but also shared by the public. The virtue and cultivation of handing down the old are scarce resources in this era. Facing this era of high materialism and utilitarianism, it is necessary to balance the spirit of handing down the old. Welcome everyone to participate in the excavation, research and study of the idea of inheriting the virtues of the old, so that the excellent spiritual quality of inheriting the old can become a valuable asset of social spiritual civilization.

Later, Master Minghai presented Master Yan Jue, president of the Chinese Buddhist Association, with the inscription "May the sorrow be great and deep" to mark the anniversary of the silence of the Chuanyin elders. This was an admiration and affirmation of the life of Chuanyin elders. On behalf of Torinji, Master Da ‘an accepted the compassion calligraphy of Master Yan Jue.

At 15: 30, the commemorative meeting of the death anniversary of the Chuanyin elders was held in three venues: Zimei Hall, Moshu Hall and Haoran Hall on the second floor of Yilu Pavilion. The first venue was presided over by Master Miao An, vice president of Jiangxi Buddhist Association, and Master Da An, abbot of Torinji in Lushan Mountain, accompanied the elders of various mountains and had a discussion with Dade Bhikkhu, who had a deep relationship with the old.

The second meeting place was presided over by Master De Jin of Torinji Pure Land Court, and monks from all over the country, such as masters, methods, monks and students, attended the discussion.

The third meeting was presided over by Master Deyong of Torinji Pure Land Court, attended by Master Hui Shou, the head of the ancestral court’s merit department, and Master Hui Ya, the head of the pure land court’s merit department. Your dharma protectors Tan Yue and the people who are destined to lay down their lives participated in the discussion.

At about 17 o’clock, the discussion of each group ended, and the anniversary of the death of the Chuanyin elders was complete.

The compassion and wisdom of the elder Chuanyin is not only reflected in his self-cultivation of Buddhism in his life, but also reflected in the fact that he left countless disciples with such a common cause of learning and growing up. Donglin disciples realized the elder’s deep compassion. Through such commemorative activities, the public can gather at the foot of Amitabha Buddha every day to commemorate the old age and experience the spirit of the elder’s birth of "a burning house with a violet" and "suffering and hardening into a diamond."

Tens of millions of property of bribery businessmen in Gansu were transferred to the name of discipline inspection officials.

From April 13th to 15th, Chen Yichao’s bribery case was heard in the People’s Court of Ganzhou District, Zhangye City, Gansu Province. China Youth Daily Zhongqing Online Reporter Lu Yijie/photo

Chen Yichao, 57, has gray hair. He hunched slightly and limped into the court, expressionless.

At one time, the gold merchant’s biggest handwriting was to earn 100 million yuan in one fell swoop; However, after the procuratorate found that he paid a bribe of 300,000 yuan for a car, he lost his freedom. Although there is no trial or conviction, as early as more than four years ago, Chen Yichao’s property of at least 10 million yuan has nothing to do with him — — Some commission for discipline inspection, discipline inspection cadres and prosecutors have become the masters of these wealth.

Among these properties, three cars were transferred to the General Office of the CPC Gansu Provincial Commission for Discipline Inspection, and two cars were changed to the name of the staff of the People’s Procuratorate of Ganzhou District, Zhangye City, Gansu Province. In addition, at least 9.52 million yuan of funds were transferred to the personal accounts of the discipline inspection cadres in Gansu Province and the prosecutors handling cases in the People’s Procuratorate of Ganzhou District, and one of the transfers was handled by the wife of the discipline inspection cadres working in the bank.

The interviewed scholars told China Youth Daily and Zhongqing Online reporter that in the process of criminal proceedings, any institution can only temporarily detain the property before the court decides, and cannot transfer the ownership. If the property is transferred to an individual’s name, "it is a violation of discipline and a new corruption."

"In this case, I think it is not a big deal to be suspected of bribery. The big thing is these properties!" At the trial site of Ganzhou District People’s Court on April 13, Chen Yichao, who pleaded not guilty, said that he would report the case handlers.

Gold miners were questioned by prosecutors at the provincial commission for discipline inspection.

Chen Yichao is from Tianshui, Gansu. Earlier, he worked in Tianshui Station of Gansu Provincial Material Administration Bureau for 17 years. There was a special railway line for transporting ore in the station, and he contacted a group of people who "mined". In the mid-1990s, when the Property Management Bureau was restructured, Chen Yichao decided to find his own way out and do "mining" business.

The gold mine brought wealth to Chen Yichao, which also made his fate turn sharply. In late May 2011, he was taken away by the case handlers in Lanzhou, and then the case handlers found his wife Fan Xiuling from the hotel.

Fan Xiuling used to be an employee of a bank in Tianshui. She recalled that she was asked about the relationship between Chen Yichao and citic guoan Gold Company, and what property she had at home, such as real estate, vehicles and deposits in bank cards.

Citic guoan Gold Company is a wholly state-owned subsidiary of CITIC Guoan Group, which is well-known in the domestic gold industry. In May 2000, Chen Yichao, who wanted to develop Toutanzi Gold Mine in Huixian County, Gansu Province, reached a cooperation intention with the gold company in the name of a company.

In the next three years, the Gold Company won the exploration right and decided to set up a new joint-stock company in cooperation with another state-owned enterprise in Huixian County. The Gold Company invested in mining rights and held 37% of the shares.

Due to the restructuring and other reasons, the gold company actually withdrew from business. In June 2006, Chen Yichao agreed to transfer 37% of his shares in the name of Gold Company, which made him earn 101.88 million yuan.

"Many of the previous investments were made by others, and this income has to be paid back." Fan Xiuling said. After several years of hard work, Chen Yichao bought eight properties in Beijing, Shanghai, Xiamen and Sanya, including BMW, Mitsubishi and Audi.

These properties are now considered by Ganzhou District People’s Procuratorate to be purchased with illegally profited funds. The indictment alleges that in the process of cooperation with the gold company, Chen Yichao repeatedly promised to reward Liu Wenge, the former deputy general manager of the company, after making profits. In May 2007, Liu Wenge offered to buy a car for him, and Chen Yichao paid 307,000 yuan with his personal bank card and bought a Toyota Camry car for Liu Wenge.

According to the indictment, Chen Yichao concealed the fact of cooperation with the gold company and obtained the exploration right in the name of the company; Without application, approval, filing or approval, the exploration right was privately invested in the name of the gold company, and then transferred to other companies, which obtained huge illegal benefits and "actually made a profit of 95.17 million yuan".

On May 29, 2011, the People’s Procuratorate of Ganzhou District decided to place him under residential surveillance. At first, he was suspected of corruption.

Chen Yichao, who is not from party member, has experienced the plot that he only saw on TV. According to the investigation or interrogation record of Gansu Provincial Commission for Discipline Inspection and Ganzhou District People’s Procuratorate, he was investigated or interrogated many times in the "case handling point of Jin Peng Building Provincial Commission for Discipline Inspection in Lanzhou City". The interrogators and investigators were both Ganzhou District prosecutors and Gansu Provincial Commission for Discipline Inspection cadres.

At the scene of the trial, Chen Yichao repeatedly said that he had been living in the case-handling point of the Provincial Commission for Discipline Inspection of Jin Peng Building during more than 200 days of residential surveillance. The prosecutor did not deny this.

According to the reporter’s field visit on April 10th this year, the Jin Peng Building, which opened in 2004, has 12 floors, and only all the street windows on the fifth floor are surrounded by iron bars. Fan Xiuling said that the fifth floor is the case handling point. The reporter tried to stay on the fifth floor of the building, but the waiter declined on the grounds that the water pipe was broken and there was no hot water.

Search, seizure and freezing, Chen Yichao’s property was involved in the storm of criminal cases. On the third day of residential surveillance, the Gansu Provincial Commission for Discipline Inspection temporarily withheld the "cash of 300,000 yuan" involved. A month later, all vehicles under Chen Yichao’s name were temporarily detained.

At least 9.52 million yuan has been transferred to the personal account of discipline inspection cadres or prosecutors.

There are more and more properties withheld and sealed, and Fan Xiuling didn’t know where the money was stored until November 25, 2011.

Fan Xiuling said that the investigators found her and asked her to remit 700,000 yuan from her China bank account with the last number of 1584 to a personal name called Jia Yuan. Jia Yuan is a cadre of Gansu Provincial Commission for Discipline Inspection contacted by Fan Xiuling. According to public reports, in 2013, Jia Yuan was still attending the meeting of the discipline inspection department in Gansu Province.

"I’m not voluntary, I said I don’t turn. The case handler said that this was illegal income. I think the statement is weird, but I don’t understand it specifically. In the end, it’s not up to me. " Fan Xiuling said, "I don’t know about other issues, but I work in a bank and I have to use a court judgment to deduct deposits. I know that."

The Application for Remittance in China Bank shows that the purpose of this remittance is "case payment". Another Receipt for Bank Card Withdrawal of Agricultural Bank of China stated that on the same day, Jia Yuan also received a "Kaka Transfer" of 900,000 yuan from Chen Yichao’s bank card.

On the same day, the Gansu Provincial Commission for Discipline Inspection recorded in the registration form of temporarily detained and sealed items that "the cash involved in the case handed over by Fan Xiuling was 1.6 million yuan only", which was the sum of the two transfers. The registration form shows that the custodian of this paragraph is Jia Yuan. The reporter found that the custodian of the other six registration forms is also Jia Yuan.

On this day, Chen Yichao was released from residential surveillance and changed to bail pending trial, and the alleged crime was also changed to bribery.

Chen Yichao and his wife began to investigate where the money was temporarily detained and sealed. They retrieved the bank voucher and found that at least 5 funds and 8.52 million yuan had been transferred to Jia Yuan’s personal account with the ending number of 8717. The opening bank of this account is Lanzhou Jinchang Road Sub-branch of Agricultural Bank of China, and the seal of one receipt shows that the manager is a Ms. Zhu.

China Youth Daily reporter came to the business office of the branch on April 11th this year. Many employees said that Ms. Zhu was indeed an employee in the business office and worked on the 5th floor of the building. Official sources confirmed that she was the wife of a cadre of Gansu Provincial Commission for Discipline Inspection. The cadre participated in the investigation of Chen Yichao’s case, and his name was seen in the transcript many times.

Among the aforementioned transfers, the earliest known transfer was RMB 1.803 million on October 19, 2011, which was used as "payable". At that time, Chen Yichao was still monitoring his residence.

The name "Sun Wannian" was signed at the signature of the remitter and the blank space of the payee’s information. The reporter found that the contact number left in the "payer" column was also Sun Wannian’s. He was qualified as a senior auditor in 2010. In a public information in March 2012, he was identified as the deputy director of the Audit Bureau of Tianzhu County, Gansu Province.

The personal account of the prosecutor also received the money involved. On November 7, 2011, a man surnamed Yan’s account had 1 million yuan remitted to the account of Industrial and Commercial Bank of China named "Chen Guoxun". Four days later, the money was recorded in the registration form of temporarily detained and sealed articles of Gansu Provincial Commission for Discipline Inspection, and the witness was Chen Guoxun.

Chen Guoxun is the prosecutor of the Anti-Corruption Bureau of Ganzhou District Procuratorate who interrogated Chen Yichao. In April 2014, Chen was appointed as a member of the Procuratorial Committee of Ganzhou District Procuratorate.

Li Chengyan, a professor at the School of Government Administration of Peking University, told reporters that no matter what the situation, there are serious problems in transferring the money involved into personal accounts, which are unreasonable, unreasonable and illegal. Zhu Xiaoding, a defense lawyer and lawyer of Beijing Cailiang Law Firm, presented these transfer vouchers during the trial.

The prosecutor responded that if there is evidence that the money is remitted to the personal name of the prosecutor and the cadre of the Commission for Discipline Inspection, it can be reported and charged.

The prosecutor did not explain whether the money later flowed to a special account. However, she said that when she received the money involved, she had received a check with an amount of 24.7087 million yuan. The defense lawyer asked for verification in court, but the prosecutor did not show it.

Three cars, including BMW, were transferred to the General Office of the Provincial Discipline Inspection Commission.

Chen Yichao and his wife did not expect that although they walked out of the residence where they lived under surveillance, their three cars were transferred to the General Office of the Gansu Provincial Commission for Discipline Inspection. The three cars are BMW compact car, Pajero compact off-road bus and Audi Q7 compact off-road bus. The license plates are Shanghai FL8996, Beijing EP7763 and Beijing KX0829 respectively.

China Youth Daily Zhongqing Online reporter confirmed from official sources that the owners of these three cars were originally Chen Yichao, but they were all changed to "General Office of Gansu Provincial Commission for Discipline Inspection".

In fact, the transfer of vehicle ownership has already begun before the investigation stage is over. In late December 2011, the first car completed the ownership transfer procedure, and the next day, the Anti-Corruption Bureau of Ganzhou District Procuratorate just formed the Investigation End Report.

At the beginning of January 2012, the last car was transferred to the name of the General Office of the Commission for Discipline Inspection. However, two months later, the Zhangye City Procuratorate handed over Chen Yichao’s bribery case to the Ganzhou District Procuratorate for review and prosecution.

According to official sources, the registration of each car was transferred from Beijing and Shanghai on the day when the transfer formalities were completed. In the summer of 2012, BMW and Audi cars underwent annual inspection, which means that the new owners may have used the vehicles.

In 1998, the Notice of the Commission for Discipline Inspection and the Ministry of Supervision of the CPC Central Committee on Strengthening the Management of Confiscation and Recovery of Illegal Funds and Articles by Discipline Inspection and Supervision Organs stipulated that all confiscated and recovered funds and articles handled by the case-handling offices should be handed over to the financial department of the organ for unified management, and the financial department of the organ should be managed by a special person and set up a special account; Temporary detention and storage of funds and materials should also be properly managed by special personnel; No interception, misappropriation, embezzlement or private sharing is allowed.

According to Chen Yichao’s statement in court, the transfer procedures of these three cars were handled by the case handlers with their official seals in Beijing and Shanghai at the end of 2011. The prosecutor did not comment on this.

For the reason of "transfer before judgment", some media recently contacted some case handlers of the Gansu Provincial Commission for Discipline Inspection, but they were rejected. On the afternoon of April 15, the relevant office phone number of Gansu Provincial Commission for Discipline Inspection was not answered.

Two other cars were also accused of involvement. Lawyer Zhu Xiaoding introduced that the cars were Audi A6L sedan and Toyota Camry sedan, and the license plates were Jing HL4986 and Jing NR1807 respectively. They were transferred to Dong Shaohua and Ma Jian around the end of 2011. The reporter confirmed this statement from official sources.

Zhu Xiaoding asked the public prosecutor to issue the identity information of Dong Shaohua and Ma Jian, but the public prosecutor did not produce it. The public prosecutor later said that if there is a problem with the disposal of property, the defender can directly sue.

Insiders of Ganzhou District People’s Procuratorate told China Youth Daily that Ma Jian was a section-level procurator of the hospital, while Dong Shaohua was a driver of the hospital, accounting for the establishment of the workers. However, the name of the driver Dong Shaohua appeared in the "Inquirer" column of an inquiry record on September 20, 2011.

"How can the property be transferred to the unit or individual?" Professor Li Chengyan is puzzled. Zhu Lijia, a professor at the National School of Administration, said that before the court ruled, the property involved could only be seized and ownership could not be transferred.

The reporter noticed that some of the undertakers and custodians of the case overlapped. Gansu Provincial Commission for Discipline Inspection’s registration forms of temporarily detained and sealed articles on June 10th and 19th, 2011 show that three vehicles were temporarily detained and sealed in these two days, and the investigators were Sun Bing and Bai Zhao Bin, and the custodians were also them. Their names also appear in the "inquirer" or "talker" of several transcripts.

If the supervision department of the Central Commission for Discipline Inspection handles the case by itself, this practice is not allowed. In 2007, "Regulations on the Management of Money and Articles Involved in Self-managed Cases by the Supervision Department of the Central Commission for Discipline Inspection (Trial)" requires that the management of money and articles involved must be legal, fair, accurate and timely, the case undertaker and the custodian should be separated, and the case handling department and the custody department should perform their respective duties.

The procuratorate refused to check and identify the money involved on the spot.

The problem of property was finally exposed in the prosecution stage.

Lawyer Zhu Xiaoding found that in July and September, 2015, Ganzhou District Procuratorate issued two identical indictments, both of which claimed to "recover a Toyota Camry from Liu Wenge". However, in December of that year, this car disappeared from the registration form for the transfer and handling of money and materials involved by the Gansu Provincial Commission for Discipline Inspection and the prosecution.

In this regard, the public prosecutor explained that Liu Wenge’s case had been finalized in November 2012 and the car had been disposed of. She didn’t issue a handling voucher. In fact, this is the car that was transferred to the name of Dong Shaohua, the driver of the procuratorate in 2011.

The aforementioned registration form shows that the money involved in the case was transferred to 24.7087 million yuan, and another 178,900 yuan was turned over to the state treasury. Zhu Xiaoding believes that the case has not yet been decided and there should be no money turned over to the state treasury.

In January 2016, the prosecution again issued a change indictment, adding a series of property lists sealed up, detained and frozen by the Gansu Provincial Commission for Discipline Inspection, including three cars that have been transferred to the General Office of the Gansu Provincial Commission for Discipline Inspection.

Chen Yichao and his lawyer said that Pajero was purchased in December 2000, which obviously has nothing to do with the bribery case; Another car that was transferred to the name of Ma Jian, a procurator at the official level, is not in the indictment and should be returned.

The prosecutor did not respond to this at the trial.

The list of withheld money and materials such as vehicles also attracted the attention of defense lawyers. The lawyer said that there are several registration forms and search transcripts of temporarily detained and sealed items on different dates in the file, but there is only one search warrant. The prosecutor admitted that the investigation organ only transferred a search warrant.

According to the lawyer, the investigators of many of the aforementioned lists are cadres of the Commission for Discipline Inspection and the witnesses are prosecutors handling cases. According to the judicial interpretation, the case-handling personnel should not be witnesses.

Yang Xuelin, a lawyer of Beijing Shouxin Law Firm, pleaded not guilty to Chen Yichao. He believes that Chen Yichao does not have a Beijing hukou, and buying a car is only under the name of Liu Wenge, the former deputy general manager of CITIC Gold Company, not a bribe; Chen Yichao didn’t seek illegal benefits, and Liu Wenge didn’t provide substantial help to Chen before the company was transformed into a private enterprise.

The prosecutor insisted that the facts of Chen Yichao’s bribery crime were clear and the evidence was indeed sufficient.

In fact, even if he was acquitted, more than four years ago, Chen Yichao’s tens of millions of property had been transferred to the name of the case-handling unit or individual. Legally, these properties were at least once owned by others.

On the morning of April 14, Chen Yichao and his defense lawyer proposed to check and identify the money and goods involved, such as the transfer of the temporarily detained vehicle and the vehicle odometer, to determine whether the vehicle has been used after being temporarily detained. They also want to check whether the detained cigarettes and alcohol were originally purchased by Chen Yichao.

When the presiding judge asked the public prosecutor for advice, the public prosecutor did not object.

Professor Li Chengyan told reporters that many people reported that some corruption control departments, such as customs, made a fortune because of their governance. "Sometimes, it is right to confiscate the money and goods involved, but where the money flows is a new problem. Some are distributed internally, and some even take it for resale. "

However, on the morning of April 15, Chen Yichao made his final statement, and the defense lawyer asked the court to arrange to check the money and materials involved, but the prosecutor refused, and the defense lawyer then protested.

After a 10-minute recess, the presiding judge relayed the prosecutor’s reply after asking the leaders of the procuratorate: the procuratorate did not agree to show the money and materials involved in the case in court, nor did it agree to arrange for on-site inspection.

  Newspaper, Zhangye, Gansu, April 15th

Hangzhou labor inspection department intervened to investigate the "996" working system of a company.

Recently, an e-commerce company publicly announced at the annual meeting that it would implement the "996" working system, making the increasingly common overtime problem in the Internet field once again become the focus of debate. Yesterday afternoon, Beijing Youth Daily reporter learned from the labor inspection department where the company belongs that the staff has been involved in investigating this matter, and if the illegal overtime behavior is true, the enterprise will be investigated and dealt with according to law.

  "996" system

Work more than 10 hours a day

Recently, a company named "Hangzhou Youzan Technology" announced at the meeting that it will implement the "996" working system in the future, that is, it will arrive at the post at 9: 30 every morning and work until 9: 00 pm. In case of emergency projects, work 6 days a week, and the working hours may be longer every day.

In addition to requiring employees to work more than 10 hours a day, some people who participated in the annual meeting also broke the news. When the company executives spoke, they suggested that if they could not properly balance work and family, they could choose to divorce.

Encourage overtime work and ignore employees’ legitimate welfare benefits … … Soon, the annual meeting of Zanzan was questioned because of the above remarks.

  "overtime work"

It has been repeatedly put forward by enterprises in recent years.

The reporter of Beiqing Daily learned that this is not the first time that the "996" work system has caused controversy. In October 2016, the Internet company 58 was exposed to the implementation of the "996" work system for all employees, and the CEO of the company was also denounced by employees. At that time, the "996" working system proposed by 58 cities means that the working hours are from 9 am to 9 pm, and there are no subsidies or overtime pay, and no leave is allowed. Since then, 58 parties have responded that the so-called "996" is only a routine mobilization, not a mandatory requirement, and its purpose is to meet the work demand with a large business volume in September and October.

The "Endeavour Application" from Jinan Inspur Group requires employees to voluntarily work 6 days a week, 12 hours a day, voluntarily give up all paid annual leave and voluntarily work overtime without instructions. Not only that, "Endeavors" have to work overtime unconditionally during the Spring Festival, National Day and other holidays, and they are on call.

  Controversy

The labor inspection department intervened in the investigation.

On January 30th, Hangzhou Xihu District Labor Inspection Brigade said in an interview with the media that it had noticed the above-mentioned news and intervened in the investigation. Yesterday afternoon, the reporter of Beiqing Daily called the Xihu District Labor Inspection Brigade and learned that the staff of the brigade had gone to the company for investigation. As of 5 pm that day, the investigators had not returned to the team. Follow-up progress will be announced after the investigation.

In addition, the All-China Federation of Trade Unions also reprinted media reports yesterday to explain the possible legal risks in the "996" work system. According to the article, according to the law, the working hours system of workers is divided into standard working hours, comprehensive working hours and irregular working hours, of which the latter two are special working hours systems and can only be implemented after approval by the labor administrative department. As for the standard working hours system, according to the Labor Law and the Provisions of the State Council on Working Hours of Employees, the daily working hours should not exceed eight hours and the average weekly working hours should not exceed forty hours. If overtime is needed, the working hours can be extended only after consultation with trade unions and workers. And no more than 3 hours a day, no more than 36 hours a month.

  If you don’t work overtime

Worried about not being able to complete the performance appraisal.

It is understood that in recent years, with the continuous development of the Internet industry, many company employees have actively or passively extended their working hours.

Wang Wei (a pseudonym), who just graduated from a robot research company this year, said that since he joined the company, it has been the normal state of his work to get off work at 9 or 10 pm. "It is very good to arrive at the company at 9 am and leave at 9 pm, and basically take a day off at the weekend." He said that although the company promised to get off work at 7: 00 pm when signing the contract, it was difficult to guarantee the off-duty time after actually taking part in the work. "How dare you leave without everyone leaving?"

Talking about the reasons why overtime is so serious, Wang Wei said that a large part of it is based on herd mentality, and in addition, he is worried that the year-end KPI (key performance indicator assessment) will not be completed. He revealed that among the students who have been employed, most of the jobs with an annual salary of 200,000 to 250,000 have reasonable working hours, and more than 300,000 basically have to accept overtime.

Li Chen (pseudonym), who has worked in a number of internet giants, said that whether to work overtime mainly depends on the company style and even the requirements of the department. "Most companies don’t force employees ‘ 996’ , but it will provide some benefits for employees who leave work late and encourage overtime in disguise. In addition, bosses who like to work overtime will also brainwash everyone mentally, telling stories of famous companies and encouraging everyone to continue their work. As for overtime pay, it is relatively small, and it will only be available in case of emergency projects. "

  Lawyer’s statement

"996" working system or suspected of breaking the law

Lawyer Han Xiao of Beijing Kangda Law Firm said that from the perspective of the Labor Law, the "996" work system may be suspected of violating the law. According to "Regulations of the State Council on Working Hours of Employees" and "Measures for Examination and Approval of Enterprises Implementing Flexible Working Hours and Comprehensive Working Hours" and other relevant regulations, enterprises need to go through the examination and approval of the labor administrative department before implementing a special working hours system different from the standard working hours system. "Therefore, if there are praises, it will be implemented without approval ‘ 996’ Working system is illegal. "

According to the provisions of Article 41 of the Labor Law: "Due to the needs of production and operation, the employer may extend the working hours after consultation with the trade unions and laborers, generally not exceeding one hour per day; If it is necessary to extend the working hours for special reasons, the working hours shall not exceed three hours a day, but not more than thirty-six hours a month under the condition of ensuring the health of the workers. " It can be seen that, except for a few special cases stipulated by law, enterprises may not force employees to work overtime, and they must obtain the consent of employees if they want to work overtime, and strictly control it within a certain period of time.

According to Article 90 of the Labor Law, "If an employer violates the provisions of this Law and extends the working hours of laborers, the labor administrative department shall give it a warning, order it to make corrections, and may impose a fine."

Lawyer Han Xiao said, "You praised the company’s ‘ 996’ Whether the working system is illegal is still under investigation, but it obviously has not played a positive social guiding role, but has caused adverse social impact. It is suggested that enterprises should not blindly pursue interests and ignore their social responsibilities when formulating internal related systems. "
